So this subject of prostitution! Often, I see people on the networks asking questions about prostitution. The first instinct we have on this subject is to say “I didn’t know”. It’s the human reflex to say: “Well, I didn’t know. I am not complicit in something of which I had no knowledge.” There is something very important to know with the law, which is that this argument is not legally understandable, that is to say that if there were to be a legal escalation on the frequent arrival of prostitutes in your apartment, a legal escalation linked to co-ownership, for example. As a seasonal entrepreneur, we are like hoteliers with the same legal expectations, and therefore the same legal responsibilities. A hotelier who says that “in one of the hotel rooms, he did not know” is not at all understood by the law. If prostitution is recognized in our apartments, it can be recognized as complicity in human trafficking or pimping. So, it's pretty serious. And just to give you the information of what we risk, we risk up to ten years in prison and — I don't want to say anything stupid to you — up to 750 thousand euros in fines. So, I think that over the next ten years, you plan to do something other than use it behind bars. There you go, we have plans, we have other things to do than that, so we're going to try to avoid that, because the law really says that: "If we have an establishment, even if it is not a prostitution establishment, if we have a place, premises where there has been prostitution, or there has been tolerance of prostitution, in all cases, we are responsible and complicit.” So “responsible” is not the right word, but I am not a crooked lawyer. I'll share with you what I saw. Don’t hesitate to talk to people who are lawyers on the subject. But we are complicit, in fact, complicit in this prostitution, even pimping and human trafficking, so it is very serious. 10 years in prison is serious, a fine of 750,000 euros is also very serious. So, how can we protect ourselves, in fact, from the law in this situation? Since we are not supposed to know, but at the same time, we are attributed as potentially accomplices. The only thing that will protect you from the law in this situation is to alert you as soon as you suspect prostitution, whether before the stay, during the stay, or even after the stay. And in fact, it's this alert... And besides, I'm going to read to you what the Penal Code says, because what's important, moreover, I didn't specify it, but all that, that falls under the Penal Code. We are not talking about business, commercial code, etc. No, no. It's not at all relaxed like that. It's really directly criminal code. This is also why we can face prison and so many financial fines. What the Penal Code says is article 225 11.1 - if you're interested - is that: "Any person who has attempted to commit the offenses provided for in this section - therefore the fact that we is welcomed in our premises, potentially, there has been tolerance of prostitution in our premises - wait, I'll spare you the bla-bla-bla, we don't care - if we have notified the administrative or judicial authority that we have allowed to avoid the commission of the offense or to identify it, if necessary, we are released", in fact, we are exempt from punishment, that's it. I found it a little difficult to read for you. I encourage you to return to article 225.1 of the Penal Code. In any case, I will try to provide you with the link to the AIRBNB document which I find very well done on this subject. There you go, we are exempt from penalty, if we ever contributed to alerting or helping to determine this, this prostitution. 

So who should you contact in these cases? There is a judicial police authority which welcomes feedback on this subject. You have two elements. The first element is an email to doc.ocrteh@interieur.gouv.fr , you send an email saying that you have a suspicion about this. And in fact, this email protects you, because you alerted of a suspicion, you are not complicit in this situation and you are in what situation to protect. There is also a telephone number, but in my opinion it is better to leave a written record. The telephone number is 01 40 97 81 25 25. What I wanted to share with you is that there are elements in your apartment that can be repellent, in quotes, for this clientele! The first is the noise detector, and the second is the camera outside. Maybe I'll explain it in more detail in another live, where I'm not coughing endlessly. In short, who cares, what I'm going to share with you is that you have the possibility of putting a noise detector in your apartment and the possibility of putting a camera that films the outside of the apartment. Having these two devices is not enough, you must also indicate in the travelers, in the messages sent to your travelers before their arrival, that you indicate that you have these devices. And sometimes, I even had cases where, in fact, the simple fact of announcing it, without even having it, ultimately, was enough to cancel these reservations which were doubtful. Besides, it also works for parties. So, having these two technical supports in your apartments will allow you to reduce the frequency of this clientele, which creates nuisances compared to co-ownership, which can put you in a bad position. It is true that especially the cameras outside which film arrivals and departures are an element which will worry even more the clientele, who are prostitutes, since these are clients who, precisely, have a lot of back and forth in their apartment, and who prefers to be anonymous, rather than having video traces of what happens in the apartments she frequents.
